In law, waiver is the release, submission or denial of an interest, claim, civil process, appeal, privilege, possession, or right, in particular with the intention of not to proceed or reaffirm. Such deliberate action may take the form of termination or neglect. This broad meaning has a number of applications in various branches of law. In the jurisdiction of common law, both the neglect of general law and legal neglect of the property can be identified.

The ignorance of the common law is "the release of the right [in the property] by its owner regardless of future ownership by himself or others, and with the intention to leave it [sic] or leave true...." or " the release of goods voluntarily by its owner in order to terminate its ownership, and without the intention of the ownership of others, the absolute delivery of goods, without reference to any particular person or purpose.... "On the contrary, an example of a legal disregard (albeit within the jurisdiction of the law common) is abandoned by a bankrupt trustee under 11 USCÃ, § 554.

In Scottish law, the failure to assert legal rights in a meaningful way abandoned the property is called "taciturnity", while the term "waiver" in Scottish law specifically refers to the procedure by which a party submits a civil or appeals process..
